Terms of Service
Blue Motion Academy
Beta service. Blue Motion Academy is an early, pre-release product offered for evaluation and learning. It is a work in progress. Features can change, break, or disappear, and the whole service may go offline without notice. Please do not rely on it for anything important.
Not legal advice. This document is a plain-language template. It is not legal advice, and reading it does not create a lawyer-client relationship. Have qualified counsel review these Terms before you rely on them.
1. Who we are and what these Terms cover
These Terms of Service (the "Terms") are a binding agreement between you and Blue Motion Academy ("we," "us," or "our"). They govern your access to and use of the Blue Motion Academy website, sign-up flow, mobile app, AI coach, and any related content or services (together, the "Service").
By creating an account, checking the box to accept these Terms, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is part of this agreement. If you do not agree, do not use the Service.
2. This is a beta. Read this part.
The Service is provided as an early-access beta for the purpose of learning and giving feedback. You understand and accept that:
- The Service is experimental and under active development. It may contain bugs, errors, and incomplete features.
- We may add, change, suspend, or remove any part of the Service at any time, for any reason, without notice or liability.
- We may reset, lose, or delete data, including your account, progress, and content, during the beta. Keep your own copy of anything you care about.
- We do not promise any level of availability, uptime, performance, or support during the beta.
- Access to the beta is a revocable privilege. We can end your access at any time.
3. Educational content is for learning only
Blue Motion Academy teaches software engineering with AI. Everything on the Service, including lessons, examples, AI coach responses, generated code, specifications, and reviews, is provided for general educational purposes only.
- It is not professional, legal, financial, security, or engineering advice, and it is not a substitute for your own judgment or for a qualified professional.
- AI-generated content can be wrong, incomplete, biased, or out of date. You are responsible for reviewing, testing, and validating anything you rely on, especially any code you run or ship.
- We do not warrant that any information on the Service is accurate, complete, current, or fit for any purpose. You use it at your own risk.
4. Eligibility and your account
- You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms.
- You are responsible for the accuracy of the information you give us and for keeping your login credentials secure. You are responsible for all activity under your account.
- Tell us promptly at info@bluemotionacademy.ai if you suspect any unauthorized use of your account.
- You may sign in using a third-party provider (for example, Google or Apple). Your use of that provider is governed by its own terms.
5. Acceptable use
You agree not to:
- break the law, infringe anyone's rights, or use the Service to harm others;
- reverse engineer, scrape at scale, overload, probe, or interfere with the Service or its security;
- resell, sublicense, or commercially exploit the Service without our written permission;
- misuse the AI coach to generate unlawful, harmful, or abusive content; or
- upload anything that is unlawful, infringing, malicious, or that you do not have the right to share.
We may investigate and act on any suspected violation, including suspending or terminating your access.
6. Your content
You keep ownership of the content you submit, including code, specs, and messages ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, display, and use Your Content solely to operate, improve, and secure the Service. You are responsible for Your Content and confirm you have the rights to share it.
7. Our intellectual property
The Service, including its lessons, curriculum, software, design, and brand, is owned by Blue Motion Academy or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own learning. All rights not granted are reserved. "Kiro" and other third-party names are used for educational reference and belong to their respective owners.
8. Third-party services
The Service relies on and links to third parties, including AI model providers and identity, hosting, and analytics vendors. We do not control them and are not responsible for their content, availability, or practices. Your use of a third-party service is governed by that party's terms.
9. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available," with all faults and without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Service will be uninterrupted, secure, error-free, or that any information on it is accurate or reliable.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing in these Terms removes rights you have as a consumer that cannot be waived under the law where you live.
10. Limitation of liability
To the fullest extent permitted by law:
- We are not liable for any information on, or generated by, the Service, or for any decision you make or action you take in reliance on it.
- We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business, arising out of or relating to the Service, even if we were advised such damages were possible.
- Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim, or fifty US dollars ($50).
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. We do not exclude liability for anything that cannot lawfully be excluded, such as fraud, gross negligence, or death or personal injury caused by our negligence.
11. Indemnification
You agree to indemnify and hold harmless Blue Motion Academy and its people from any claims, losses, and reasonable costs arising out of your misuse of the Service, your violation of these Terms, or your infringement of anyone's rights, to the extent permitted by law.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or end your access at any time, with or without notice, including if you violate these Terms or if we discontinue the beta. Sections that by their nature should survive, including sections 3, 6, 7, 9, 10, 11, and 14, survive termination.
13. Changes to these Terms
Because this is an evolving beta, we may update these Terms. If we make a material change, we will take reasonable steps to let you know, such as posting a notice or emailing you. Changes take effect when posted with a new "Last updated" date. If you keep using the Service after that, you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Santa Clara County, California for any dispute, unless the law where you live gives you the right to bring a claim elsewhere. Nothing here removes any mandatory consumer-protection rights you have locally, including for users in the EU and UK.
