Beta service. Blue Motion Academy is an early, pre-release product. Our data practices may change as the product develops. We will update this policy and its "Last updated" date when they do.

This policy explains what personal information Blue Motion Academy ("we," "us") collects, why, and the choices you have. It covers the Blue Motion Academy website, sign-up flow, mobile app, and AI coach (the "Service"). It is part of our Terms of Service.

1. A note on marketing and personalization

We want to be direct about this, because it is the part people care about most.

  • We may send you marketing email (product news, tips, and offers) only if you opt in to it. That opt-in is a separate step from accepting the Terms, so you can use the Service without agreeing to marketing.
  • We may personalize and target the content and ads you see based on how you use the Service, again where you have agreed or where the law allows it.
  • You can change your mind at any time. Every marketing email has a one-click unsubscribe, and you can update your choices in your account settings or by emailing info@bluemotionacademy.ai. Opting out of marketing does not affect essential account and service messages.

2. What we collect

You give us:

  • Account details: name, email address, and password or the identifier from your Google or Apple sign-in.
  • Content you submit: code, specifications, messages to the AI coach, and feedback.
  • Your communication and marketing preferences.

We collect automatically:

  • Usage and device data: pages and lessons viewed, features used, progress, approximate location from your IP address, device and browser type, and similar analytics data.
  • Cookies and similar technologies: see section 7.

We do not intentionally collect special-category data (such as health, biometric, or political data), and we ask you not to submit it.

3. Why we use it, and our legal basis

Where we rely on consent, you can withdraw it at any time. Where we rely on legitimate interests, you can object, and we will stop unless we have overriding grounds.

4. When we share

We do not sell your personal information for money. We share it only with:

  • Service providers who run the Service for us, such as hosting, AI model providers, email delivery, authentication, and analytics vendors, under contracts that limit them to our instructions.
  • Advertising and analytics partners, if you have agreed to personalization, to measure and target content and ads. Under California law, sharing personal information for cross-context behavioral advertising may count as "sharing," and you have the right to opt out (see section 6).
  • Legal and safety recipients, when required by law or to protect rights and safety.
  • A successor, if we are involved in a merger, acquisition, or asset sale, subject to this policy.

5. AI coach and your content

When you use the AI coach, your prompts and related context are sent to our AI model provider to generate a response. We use reputable providers under contracts that restrict how they use the data. Do not paste secrets, credentials, or confidential or personal information about others into the coach. AI output can be wrong. Review it before you rely on it.

6. Your privacy rights

Depending on where you live, you may have the right to:

  • access, correct, delete, or receive a portable copy of your personal information;
  • withdraw consent and opt out of marketing and of personalized advertising;
  • object to or restrict certain processing; and
  • not be discriminated against for exercising these rights.

How to use them: email info@bluemotionacademy.ai or use your account settings. We will verify your request and respond within the time the law requires.

EU and UK (GDPR): you have the rights above and the right to lodge a complaint with your data protection authority. Our representative and any Data Protection Officer are listed in section 10.

California (CCPA/CPRA): you have the right to know, delete, correct, and to opt out of the "sale" or "sharing" of your personal information and of targeted advertising. Use our "Do Not Sell or Share My Personal Information" link or email us. We do not knowingly sell or share the personal information of users we know to be under 16 without the required opt-in consent.

7. Cookies and tracking

We use cookies and similar technologies for three things: to make the Service work (essential), to understand usage (analytics), and, if you agree, to personalize and measure advertising. Where the law requires it (including the EU and UK), we ask for your consent before setting non-essential cookies, and you can change your choice through our cookie controls or your browser settings.

8. Children and teens

The Service is for users 13 and older. We do not knowingly collect personal information from children under 13. For users who are 13 to 17, we do not use their information for targeted advertising or personalization without the opt-in consent that the law requires, and we recommend a parent or guardian be involved. If you believe a child under 13 has given us information, contact us and we will delete it.

9. Marketing choices, retention, and security

  • Marketing choices: opt in when you sign up or later in settings; unsubscribe from any email; opting out is honored promptly. We always send essential service messages (for example, security or account notices).
  • Retention: we keep personal information for as long as your account is active and as needed for the purposes above, then delete or anonymize it, unless the law requires us to keep it longer.
  • Security: we use reasonable technical and organizational measures to protect your information. No method is perfectly secure, and during the beta you should not store anything sensitive on the Service.
  • International transfers: we may process information in countries other than yours, including the United States. Where required, we use safeguards such as the European Commission's Standard Contractual Clauses for transfers out of the EU and UK.

10. Changes and contact

We will update this policy as the Service evolves and will note the new "Last updated" date. Material changes will be communicated by a reasonable method.
